Structural Guarantee

This guarantee supplements any existing guarantees, statutory insurance, or home builders liability schemes applicable in Australia and is subject to the following conditions. The Lifetime Structural Guarantee pertains solely to the individuals specified in the building contract and is not transferrable to subsequent homeowners.

In this document, "Your" or "You" refers to the owners named in the building contract. "We," "Our," or "Us" refer to Pro Duplex Pty Ltd.

We will, at our expense, rectify any structural failure in the following components:

  • Structural timbers and steel in wall or roof framing, meeting the standards defined in the Building Code of Australia and relevant Australian Standards, including AS 1684.
  • Load-bearing brickwork complying with the standards outlined in the Building Code of Australia and relevant Australian Standards, including AS 4773.
  • Foundation systems, concrete, or strip footing according to the Building Code of Australia and relevant Australian Standards, including AS 2870, Appendix B.

Your Responsibility:

You must maintain your home in accordance with the documents provided as part of your building contract and other specified documents applicable in your State. This guarantee does not cover:

  • Damage from trees near your home's footing.
  • Minor cracking as defined in AS2870 Appendix B.
  • Fair wear and tear, misuse, or neglect.
  • Failure to follow site maintenance guidelines provided by us, including landscaping, drainage, and termite prevention.
  • Damage from storms, fire, flooding, drought, or earthquake.
  • Renovations, additions, or structural changes made after completion under the building contract.
  • Site conditions beyond our control post-settlement.
  • Non-structural issues like marks or scratches on surfaces.
  • Loss resulting from non-compliance with your responsibilities.

How to Make a Claim:

To claim under this guarantee, submit your request in writing via post or email to the address provided.

Eligibility for Claim:

The Lifetime Structural Guarantee applies to the owners named in the building contract, and claims must be made within their lifetime. For companies’, the guarantee period is 50 years from the certificate of occupancy.

Upon receipt of your claim:

We will review and inspect your property to determine if it meets the guarantee's requirements.

We will respond in writing with the outcome of the assessment.

If the structural failure meets the guarantee's criteria, we will begin rectification works at our expense within a reasonable timeframe.

Consumer Rights:

Your consumer rights under the Australian Consumer Law are not affected by this guarantee. You are entitled to replacement, refund, or compensation for any failure covered by consumer law. We will repair or replace goods to rectify structural failures covered under this guarantee.

If we determine that there is no structural failure or that it does not meet the guarantee's requirements, you will be responsible for all rectification costs.
